JCT: Minor screw-up in the courthouse. Though I had served
the Crown their copy of the motion to adjourn, I had faxed
the court's copy directly to Judge Belanger's chamber rather
than to the clerk. But he got it though the Crown didn't
show.
When I phoned Allyson Ratsoy, she said that it had not been
listed and she wasn't coming. Anyway, I explained to the
court clerk the mix-up in faxes explaining why the judge
might have the motion but it wasn't on the docket. Judge
Belanger stood the matter down until a Crown shows up.
The clerk checked and then called the Crown's office. Though
Allyson was in a meeting, she had her called to the phone
and then told her Judge Belanger wanted a Federal Crown
there to deal with my motion. Allyson said she'd be right
over.
I explained what was going on above but Allyson said she was
not ready to respond to the motion to adjourn. (She's ready
to go to trial.) Judge Belanger ruled that since none of
the higher applications had been been filed, there was
nothing before him to suspend his jurisdiction.
One interesting point was when the judge pointed out that
even if I was convicted, sentencing could be suspended until
after the higher courts rule. I couldn't understand why he'd
want to hand down a decision on this hot potato until he
knew what the higher courts were going to say.
Anyway, I have to be back in Ottawa for the beginning of my
trial on Thursday.
I served the Crown the Notices of Appeal against MacLeod
J.'s denial of Prohibition and for Certiorari which I'll
file with the Ontario Court of Appeal in Toronto tomorrow.
Also, I'll file the three Supreme Court of Canada
applications for Terry Parker, Marc Paquette and me to
challenge the Hitzig resurrection on Wednesday. I want lots
of upper action going on should the judge decide to go
forward with it before they get resolved.
It sure would complicate my election run and might even
interfere with my World Social Forum UNILETS presentation.
Hope not. Anyway, if it starts on Thursday, it has to deal
with the motion to quash and the constitutional question of
whether my right to life is violated by denial of marijuana
for preventative medical purposes and for environmental bio-
mass reasons. |
