This is going to be a exercise in demonstrating Fair Use rules and
their application.
Take a blank sheet of paper for this exercise.
Draw a large circle. Label it set: U
Set A is defined as representing all usenet articles ever posted.
Inside this 1st set draw a second circle label it set A: This is a
set which represents all usenet articles which are Archived.
Now inside this draw another circle. This circle represents the set
of all posts ever made by Edmond Wollmann. Label Set: K
Now Draw a circle which represents only the articles archived under
fair-use rules at www.smbtech.com/ed
Call this set: B
Edmond also make a claim some of the archived articles are
Fogeries/Frogeries.
Lets create a second Set on our diagram, Set: F This circle
represents those articles which are parodies/frogeries and purported
forgeries.
That set: F, lays outside the set: K, but intersects Sets: S
Also Since Set S doesn't not contain all of Set K, the arguments is
made Set S is Fair-use rules, and used to support commentary.
Now we have to go back and read Edmond's claims and statements and
whines from the past.
In several articles IIRC Edmond Whined about Google/Dejevu not
properly archiving his articles. IIRC it was an excuse of his for
abusive action of reposting the same article several times.
Since there is no legal difference between any archive, Edmond's
claim of copyright abuse fails.
As an aside: Edmond should consider some of the cases in the past.
Rosenthal v. Barrett jumps to mind.
