The main task of the essays in this collection is to explore this
tension between judging and understanding and almost all of the
authors use Schlink's novel to illustrate their respective theories.
The contributions are situated between two extreme positions: first,
the one according to which our retributive practices have to be given
up completely in the light of the tension between judging and
understanding, and, second, the one according to which such a tension
