Here is the correct view of the subject.
1. Many of these recordings and videos violate copyright and are
therefore illegal. Often the original copying was done illegally by
people sneaking recorders into venues in violation of house rules
posted in the hall or printed in the program or on the tickets.
2. The pirates do not pay for the cost of the original broadcast or
performance, do not pay royalties or fees, and are therefore unjustly
enriching themselves.
3. If the copyright holders don't sue the pirates, this is almost
implied consent or amounts to a policy of tolerance. Rosen and
Handelman are operating openly on a grand scale, so the copyright
holders would have no problem finding them, suing them, and shutting
them down.
4. No doubt the illegal recordings are tremendously valuable to many
fans, to many artists, and even to opera as an art form.
5. The purchasers of these recordings (I myself have some) are on
shaky ground when defending the pirates because they, the purchasers,
enjoy and even treasure the products. I imagine that those who buy
stolen automobiles or stolen paintings also enjoy the products they
possess illegally. This joy of possession cannot excuse the legal and
ethical violations.

Samurai is one of those "sour grape" people..He appears to have an axe
to grind...and there have always been bores who are so out of the
loop...they have no connection with these singers anad of course if
everything was so "illegal" why are these people (ME TOO) in jail.....
He has no connection to the artists....who are overjoyed to have these
perf. So many careers....big stars and lesser stars have been so
happy to be better kniown..careers enhanced......but people who spend
all this time trashing the pirates just put me to sleep..This has gone
on for 40 years..We pay no attention to them.
With all the money so many of them make,you would think they would be
able to easilyn sue...but instead they treasure this stuff and TELL US
they do........"
lf I made a list of the various singers who have written or spoken to
us pirates...it would read list a list of practica;ly every star and
non-star in the opera world.
The only singer who complained was Jessye Norman...and who cares.... |

One more thing...Samurai mentions Ed and I...but he fails to mention
all the other "outlets" ..Like the former Tower,, Amazon,Berkshire,
and any store or outlet that has all these perf......Let him wonder
why ENCORE DVD's are so widely distributed.
People like to blame the "little guy" and this is really our
joke...because live stuff has been around forever.
I still say these people are as jealous as can be..and are also
hypocrites because they LOVE these "illegal" performances..and would
be much less enriched without them.
With all the media on the Internet ...all the obvious advertising in
publications all over the world..by now after 40 yeatrs..we pirates
would be serving life sentences...we just laugh at the "purists" who
go on and on about these tapes.....Charlie |

Tito Gobbi, too, vehemently disapproved, but they were an apparent
minority; A great many current singers and those of the fairly recent
past have given their approval, directly or tacitly, FWIW.
So it's a 'debate' that won't likely be 'settled'; certainly not by
the Safe Mode 'net cockroaches with their fake 'names' and goofy
agendas. |
